Introduction

HK Solutions Pte Ltd and HK System Maintenance Pte Ltd does not collect your personal data except for information that individuals voluntarily provide. We are committed to safeguarding the privacy and confidentiality of any personal information you share with us in accordance with the Singapore Personal Data Protection Act 2012 and all related regulations and guidelines that may from time to time be issued by the Personal Data Protection Commission of Singapore.

Definitions

As used in this Privacy Policy:

"Personal Data" means data, whether true or not, about an individual who can be identified: (a) from that data; or (b) from that data and other information to which we have or are likely to have access.

"Business Contact Information (BCI)" refers to an individual's name, position name or title, business telephone number, business address, business email address and any other similar information about the individual, where such information is not provided by the individual solely for his personal purposes.

1. Application of This Privacy Policy

This Privacy Policy relates to our customers and users of our website.

This Privacy Policy applies to all data, in any form, about an identifiable individual which is in our possession or under our control, for the purposes of and in connection with our contractual obligations and the delivery of our services.

Under the Singapore Personal Data Protection Act (PDPA), business contact information (e.g. name, business address, business telephone number) is not treated as Personal Data so long as it is used strictly for business-to-business (B2B) purposes.

2. Collection of Personal Data

We collect Personal Data when:

  • You voluntarily provide it to us, for example when you communicate with us via email, telephone or other channels. The data we collect includes contact information (your name, phone number, email address), company name, relevant department and position/job title and will be used strictly for B2B dealings.
  • You contact us through our website, where you will be required to provide your name, phone number, address and email. The information you submit will be managed in line with this Privacy Policy.
  • You exercise your choices regarding our collection, use or disclosure of your personal data. You have the right to object to the processing of your personal data and to withdraw your consent in the manner described in section 3 of this Policy.
  • We collect, disclose or use your personal data pursuant to an exception under the PDPA or other written law.
  • In general, and subject to applicable exceptions under the PDPA, before collecting personal data from you, we will inform you of the purposes for which your personal data may be collected, used and/or disclosed, and obtain your consent for such collection, use and/or disclosure for the intended purposes. If you choose not to provide us with the personal data described in this Policy, we may not be able to carry out the purposes listed in section 4 of this Policy.
  • Any unsolicited personal data received by us will be returned to the sender where practicable. If received by email or through our website, such unsolicited data will be deleted promptly. If received by telephone, it will not be recorded.

3. Withdrawing Your Consent and Its Consequences

Upon receiving your request to withdraw consent, we may require a reasonable period (depending on the complexity of the request and its impact on our relationship with you) to process your request and to inform you of the consequences of our acceding to it, including any legal implications which may affect your rights and obligations towards us. In general, we aim to process your request within 10 business days of receipt. If more time is required, we will inform you of when the withdrawal will take effect.

While we respect your decision to withdraw consent, please note that, depending on the nature and scope of your request, we may no longer be able to continue providing our services to you, and we will notify you of these consequences before completing the processing of your request.

Please note that withdrawal of consent does not affect our right to continue to collect, use and disclose personal data where such collection, use or disclosure without consent is permitted or required under applicable laws.

4. Use of Personal Data

We use the Personal Data you provide to us for one or more of the following purposes:

  • Provide you with information that you request from us or that we consider may be of interest to you
  • Respond to your enquiries and feedback
  • Perform obligations arising from any contracts entered into between you and us
  • Enter into or manage our existing business relationship with you
  • Comply with or fulfil legal obligations and regulatory requirements

We do not sell, trade, distribute or otherwise make your Personal Data available to any third party other than as described in this Privacy Policy.

5. Disclosure of Personal Data

We may disclose your Personal Data to third party service providers, agents and other organisations that we have engaged to perform any of the functions listed in section 4 on our behalf.

Where required by law, we may disclose Personal Data about you to relevant authorities or to law enforcement agencies.

We will take reasonable steps to ensure that the Personal Data we collect about you is accurate, complete, not misleading and kept current. Where required by law or necessary to accurately verify your identity, we will validate the information you provide using generally accepted practices and guidelines. If we are in an ongoing business relationship with you, please update us on any changes to your Personal Data for the purposes described in section 4 of this Privacy Policy.

7. Protection of Personal Data

We implement appropriate administrative, physical, technical and organisational security measures to help protect your Personal Data against loss, misuse and to guard against access by unauthorised persons.

Where there is a need to disclose your Personal Data to third parties in the manner described in section 5, we will ensure that they provide sufficient assurances that they have implemented adequate security measures to safeguard your Personal Data.

8. Retention of Personal Data

We will not retain your Personal Data once it is no longer required for any business or legal purposes.

We will dispose of or destroy documents containing your Personal Data in a secure manner as soon as it is reasonable to assume that the permitted purpose is no longer served by their retention.

You may write to us using the contact details in section 12 to find out how you can request information about our data retention periods and how we destroy personal data after the end of the retention period.

9. Access and Correction to Your Personal Data

You have the right to know what Personal Data we hold and process about you. You may write to us using the contact details in section 12 to find out how we have been using or disclosing your Personal Data over the past one year.

You are also entitled to have inaccurate Personal Data about you corrected and, in some circumstances, may ask us to delete your Personal Data. You may also object to certain processing activities and request that processing of your Personal Data be restricted.

Before we accede to your access or correction request, we may need to verify your identity by checking identification documents and confirm the legitimacy of your request.

We will respond to your access or correction request as soon as reasonably practicable, or within 30 calendar days from the date we receive your request. If we are unable to meet this timeline, we will inform you and provide an estimate of the additional time required.

A reasonable fee may be charged for an access request. If applicable, we will inform you of the fee before processing your request.

10. Transfer of Personal Data Outside of Singapore

We do not transfer personal data outside of Singapore.

If a transfer is necessary in connection with the purposes listed in section 4, we will ensure that the level of data protection in the recipient country is comparable to that under the Singapore Personal Data Protection Act 2012, or we will enter into an agreement with the receiving party to provide a similar level of protection as required in Singapore.

11. Data Breach Notification

In the event of a security breach leading to accidental or unlawful destruction, loss, alteration, unauthorised disclosure of, or access to, personal data, we will promptly assess the impact and, where appropriate, report the breach within 3 calendar days to the Personal Data Protection Commission (PDPC). We will notify you when the data breach is likely to result in significant harm to you, after our notification to the PDPC, and may also notify other relevant regulators where required.
